These Terms of Service ("Terms") govern your use of Toonorama, an AI-powered photo booth experience operated by Howell XR LLC ("Howell XR," "we," "us," or "our").

By using Toonorama, you agree to these Terms.

1. About Toonorama

Toonorama is an interactive photo booth experience that captures photographs and uses artificial intelligence to create transformed, stylized, or otherwise AI-generated images.

The service may use third-party technology and infrastructure, including OpenAI for AI image processing and Google services for image storage and delivery.

2. Using Toonorama

• By using Toonorama, you confirm that you have permission to participate in the photograph and to submit the image for processing.
• If you are taking a photograph that includes other people, you are responsible for ensuring that they are aware the photograph is being taken and used with Toonorama.
• You agree not to use Toonorama for unlawful, fraudulent, abusive, harassing, defamatory, or otherwise prohibited purposes.

3. Photos and AI Processing

• When you use Toonorama, your photograph may be transmitted to third-party service providers, including OpenAI, for the purpose of generating the requested AI-transformed image.
• Generated images may differ significantly from the original photograph. Artificial intelligence can produce unexpected, inaccurate, distorted, or undesirable results.
• We do not guarantee that generated images will accurately represent any person's appearance, identity, clothing, surroundings, or other characteristics.
• If you do not want your photograph processed using artificial intelligence, you should not use Toonorama.

4. Your Photos

• You retain any rights you may have in photographs you submit to Toonorama.
• By using the service, you grant Howell XR a limited, non-exclusive license to capture, copy, transmit, process, store, and display your photograph as reasonably necessary to operate Toonorama and provide the requested experience.
• This permission includes allowing our technology providers to process the image when necessary to provide the service.
• Our collection, processing, storage, and sharing of personal information is further described in our Privacy Policy.

5. AI-Generated Images

• Subject to applicable law and the rights of others, you may download, save, and share images generated for you through Toonorama for personal use.
• Because AI-generated content may incorporate transformations based on automated systems, we cannot guarantee that any generated image is unique or that similar images will not be generated for other users.
• You are responsible for how you use or share images generated through Toonorama.

6. Event Photography and Event Organizers

• Toonorama may be provided at private events, corporate events, festivals, weddings, promotional activations, and other gatherings.
• When Toonorama is provided on behalf of an event organizer, client, sponsor, or venue, photographs and generated images may also be made available to that organization as part of the event service.
• Event-specific notices or agreements may provide additional terms regarding how photographs are used, stored, displayed, or shared.

7. Promotional Use

• Howell XR will not use a participant's photograph or AI-generated image in advertising or marketing solely because the participant used Toonorama.
• If we would like to feature identifiable participant images in promotional materials, social media, advertising, case studies, or other marketing, we may obtain additional permission where required.
• Event organizers may have their own photography, publicity, or promotional policies. Their use of event photographs is governed by their own terms and policies where applicable.

8. Minors

• Children should use Toonorama only with the permission and supervision of a parent, legal guardian, or other responsible adult where appropriate.
• Event organizers are responsible for determining whether Toonorama is appropriate for attendees at their event and for obtaining any permissions required for minors participating in the event.

9. Third-Party Services

• Toonorama relies on third-party technology and services, which may include Google, OpenAI, internet service providers, payment processors, hosting providers, and other technology vendors.
• Your information may be processed by these providers as described in our Privacy Policy.
• We are not responsible for interruptions, outages, changes, or failures caused by third-party services outside our reasonable control.

10. Availability

• We work to make Toonorama reliable, but we do not guarantee that the service will always be available, uninterrupted, error-free, or capable of generating an image successfully.
• AI services, internet connectivity, hardware, cameras, payment systems, cloud services, and other components may occasionally fail or become unavailable.
• We may modify, suspend, or discontinue portions of Toonorama when reasonably necessary.

11. Payments and Refunds

• Certain Toonorama experiences may require payment.
• Prices and any applicable fees will be displayed before purchase where Toonorama is offered directly to consumers.
• Unless otherwise required by law, payment generally covers access to the Toonorama image-generation experience and does not guarantee a particular artistic result.
• If a technical failure prevents the purchased experience from being provided, we may provide another attempt, replacement experience, or refund as appropriate.
• Separate agreements may apply when Toonorama is rented or provided directly to an event organizer or business client.

12. Intellectual Property

• The Toonorama name, branding, software, interface, designs, graphics, and other proprietary elements of the service are owned by Howell XR LLC or its licensors and are protected by applicable intellectual-property laws.
• These Terms do not grant you ownership of Toonorama's software, branding, technology, or other proprietary materials.

13. Prohibited Uses

• You may not use Toonorama to violate the law or the rights of another person.
• You may not attempt to interfere with, damage, reverse engineer, bypass, exploit, or gain unauthorized access to Toonorama, its systems, accounts, networks, or security measures.
• You may not knowingly submit content that you do not have the right to submit or use the service to impersonate, exploit, harass, threaten, or harm another person.

14. Disclaimer

• Toonorama is provided on an "as is" and "as available" basis to the fullest extent permitted by law.
• AI-generated images are created automatically and may contain errors, distortions, inaccuracies, unexpected content, or other imperfections.
• To the fullest extent permitted by applicable law, Howell XR disclaims warranties regarding the accuracy, reliability, availability, merchantability, fitness for a particular purpose, and non-infringement of the service or its generated content.
• Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

15. Limitation of Liability

• To the fullest extent permitted by applicable law, Howell XR LLC and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of Toonorama.
• To the fullest extent permitted by law, Howell XR's total liability arising from an individual consumer's use of Toonorama will not exceed the amount that individual paid Howell XR for the Toonorama transaction giving rise to the claim.
• Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold Howell XR LLC harmless from claims, damages, liabilities, and reasonable expenses arising from your unlawful use of Toonorama, your violation of these Terms, or your violation of another person's rights.

17. Privacy

Your use of Toonorama is also subject to our Privacy Policy, which explains how photographs, generated images, Google-related information, and other information are collected, processed, stored, and shared.

18. Changes to These Terms

We may update these Terms as Toonorama evolves.

When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of Toonorama after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

19. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.

Any disputes relating to these Terms or Toonorama will be handled in accordance with applicable law.
